Use of trademark

These are the terms upon which Legal & General Group Plc ("Legal & General") licences you to make use of and reproduce Legal & General’s logo and name (the "Trademarks").

By accessing this site, you agree to be bound by these terms.

Your Obligations

You shall not:

(a)

use the Trademarks in combination with any other trademark without the prior written approval of Legal & General;

(b)

produce, publish or distribute any material using the Trademarks without the prior written approval of such materials by Legal & General. The parties shall agree work together to ensure there is an efficient process for obtaining approval to standard documentation and for material amendments to such documentation;

(c)

use the Trademarks as part of any corporate, trading, business or domain name or meta-tag or other site descriptor whatsoever without Legal & General’s prior written approval;

(d)

use any other trademark so resembling the Trademarks as to be likely to cause confusion;

(e)

hold anywhere in the world any applications or registrations for trademarks which contain the Trademarks or any confusingly similar word or words (and shall not authorise or assist any third party to do so);

(f)

represent to any party that you hold any rights in the Trademarks;

(g)

do anything which impairs the registration of the Trademarks or which debases or reduces the commercial value of the Trademarks; or

(h)

do anything which damages or dilutes the value or reputation of or goodwill in the Trademarks.

Title and Goodwill

You acknowledge that Legal & General is the owner of the Trademarks and the goodwill in the Trademarks. Any goodwill derived from use of the Trademarks by you shall accrue to Legal & General.

You acknowledge the high reputation, image and prestige of the Trademarks and the commercial importance of the Trademarks to Legal & General. You further acknowledge that any action or omission by you which damages in any manner the reputation, image or prestige of the Trademarks may be of serious detriment to the business and operation of Legal & General and its licensees.

Indemnity

You agree to indemnify Legal & General in respect of all claims, liabilities, damages and expenses incurred by Legal & General as a result of a failure on your part to comply with these terms.

Infringement

You shall promptly inform Legal & General of:

a. any infringement or suspected unauthorised use of the Trademarks (including common-law rights in passing off), which come to your attention;

b. any allegation that the use of the Trademarks by you infringes the intellectual property rights of a third party.

You shall not take any steps or make any admissions regarding any infringement of the Trademarks, but shall provide Legal & General with all assistance which Legal & General may reasonably request in taking any steps against any infringement of the Trademarks. Legal & General shall have conduct of all actions, claims or proceedings relating to the Trademarks and shall in its sole discretion decide what action, if any, to take in respect of any actual or alleged infringement of the same and shall be entitled to any damages, account for profits or costs which may be obtained or awarded.

General Provisions

(a)

You may not assign or otherwise transfer all or any of your rights or benefits under this Agreement without the prior written consent of Legal & General.

(b)

You may not sub-licence or sub-contract the rights granted by these terms.

(c)

Nothing contained in these terms shall give you any right, title or interest in the Trademarks.

(d)

A subsidiary, parent or associated company of Legal & General may enforce these terms in accordance with the provision of the Contract (Rights of Third Parties) Act 1999 ("the Act") however, such third parties consent is not required to vary the terms. Except as provided in this clause a person who is not party to these terms has no right under the Act to enforce any term.

(e)

These terms will be governed by and construed in accordance with English Law and the parties submit to the jurisdiction of the English Courts.

(f)

Nothing in these terms shall constitute or be deemed to constitute a partnership between the parties hereto.
